Terms of Use
The agreement between you and MyBrain — including what it means to join a beta.
MyBrain is in controlled beta: invite-only access, evolving features, and possible instability. We invite you precisely so you'll use it for real, find what breaks, and give us feedback. These terms reflect that stage and will be updated as the product evolves — the revision date above marks the version in force. In case of divergence, the Portuguese version prevails.
These terms define the relationship between you and MyBrain. Each section opens with a plain-language summary; the full text is what governs legally. By creating an account or joining the waitlist, you agree to them.
1.Who we are and what the service is
The service is operated by MyBrain ("we", "us"); the full legal entity can be requested at support@mybrain.ai. MyBrain lets you capture original and reference content, organize it into a personal knowledge graph, and query it through AI interfaces (the "Service"). The Service is in controlled beta: invite-only access, evolving features, and the conditions in section 9.
2.Eligibility and account
To use MyBrain you must be at least 18 and have legal capacity. When you sign up, you agree to provide true information and keep it current. The account is personal and non-transferable. Access is through social login (LinkedIn or Google) or a code sent to your email; you are responsible for keeping control of the email and account you use to sign in, and for all activity on your account. Tell us immediately, through the channel in section 14, if you notice unauthorized use.
3.Your content is yours
All content you capture, upload, or create in MyBrain ("Your Content") remains yours. You transfer no intellectual property rights to us. For the Service to work, you grant us a limited, non-exclusive, revocable license, restricted to the purposes of the Service: to store, process, organize, and display Your Content to you. The license ends when you delete the content or close your account, except for what the law requires us to keep.
In line with the Privacy Policy: we don't use Your Content to train AI models, we don't sell it, and we don't use it for advertising. When an external AI provider is needed, processing happens under pseudonymization, described on the Security & Privacy page.
If you connect apps (Notion, Google Drive, Dropbox, OneDrive, Box, email) or import content from other AI tools, you confirm you have the right to that content and authorize MyBrain to process it within the scope you grant. You also confirm that the content you capture doesn't infringe third-party rights.
Your own key (optional). If you choose to use your own external AI model key, that flow is governed by the terms of the provider you chose, outside MyBrain's pseudonymization layer. The choice is yours, and it's off by default.
4.What's ours
The Service — software, design, brand, graph-organization technology, and other elements — belongs to MyBrain or its licensors. These terms grant you no rights over the Service beyond the personal, non-transferable license to use it while your account is active. The structure is ours; the knowledge inside it is yours.
5.Acceptable use
When using MyBrain, you agree not to: (a) break the law or infringe third-party rights, including intellectual property and privacy; (b) capture third-party content while passing yourself off as its author; (c) access accounts, data, or systems that aren't yours; (d) reverse-engineer, scrape, deliberately overload, or circumvent the technical and usage limits of the Service; (e) use the Service to build a competing product; (f) share your beta access without our authorization. We may suspend or close accounts that violate this section (section 11).
6.AI: what to expect from the answers
MyBrain uses AI models to organize and return your knowledge. Answers can contain errors, inaccuracies, or omissions, even when based on your own content. The Service does not provide professional advice (legal, medical, financial, or otherwise), and the outputs should not be your only basis for important decisions. It's up to you to review and validate how you use them. This section does not remove the rights that Brazil's Consumer Protection Code (CDC) guarantees you.
7.Privacy
The processing of personal data is governed by our Privacy Policy, an integral part of these terms. The plain-language version is on the Security & Privacy page.
8.Price and beta usage limits
During the beta, MyBrain is free. To keep the service stable and costs under control, the beta may have usage limits — for example, on storage, processing, or the number of interactions per period. When you reach a limit, we tell you in the interface. Paid plans will be announced at least 30 days in advance, and nothing is charged without your express subscription. The beta being free doesn't create a permanent right to free use.
9.Controlled beta conditions
By joining the beta, you acknowledge and agree that:
- The Service is in active development: features may change, be suspended, or be discontinued, and instability and downtime can happen, with no formal SLA at this stage. We invite you precisely to find these points and give us feedback.
- Participation involves feedback conversations — especially interviews after use and, in some cases, individual onboarding — as set out in the beta acceptance shown in the invitation and in the product.
- Feedback, suggestions, and ideas you send us about the product may be used freely by MyBrain to improve it, without compensation. This does not include Your Content, which remains protected by section 3.
- Beta access is personal, invite-only, and may be ended by MyBrain at any time, with prior notice and the exit path in section 11.
A two-way commitment: any change in the beta that affects Your Content or your data will be communicated directly to you before it takes effect.
10.Availability and warranties
We make reasonable efforts to keep the Service available and secure. In the beta phase, it is provided "as is", without a guarantee of continuous availability or specific performance. Nothing in this section removes the warranties and rights that Brazilian law, in particular the Consumer Protection Code, guarantees you and that cannot be waived by contract.
11.Suspension, termination, and what happens to your data
By you: you can close your account at any time, from the data-control area in the product or through the channel in section 14. Closing triggers the deletion of your data as described in the Privacy Policy; before that, you can request a copy of your data (export within 15 days).
By us: we may suspend or close accounts for breach of these terms, with a justified notice, except where immediate suspension is necessary for security or legal reasons. If the Service or the beta is discontinued, we give at least 30 days' notice, and you have that period to handle your data.
12.Limitation of liability
To the maximum extent permitted by Brazilian law, MyBrain is not liable for indirect damages, lost profits, or lost opportunity arising from the use of the Service in its beta phase, nor for decisions made based on AI outputs without the review described in section 6. This limitation does not apply to willful misconduct or gross negligence, and does not remove the liability that the Consumer Protection Code and other public-order rules impose on the supplier.
13.Changes to these terms
We may update these terms to reflect changes in the product or the law. The date at the top marks the version in force. We notify you of material changes by email at least 15 days in advance. Continued use after a change takes effect counts as agreement — but changes that broaden consent-based processing require fresh consent, never silence. We record your acceptance with the date, time, and the version of the documents in force.
14.Governing law, jurisdiction, and contact
These terms are governed by Brazilian law. The courts of your domicile are chosen to settle disputes arising from the consumer relationship, under the CDC. Contact for anything about these terms: support@mybrain.ai.
